These Terms of Service ("Terms") constitute a legally binding agreement between you ("you," "your," or "user") and Valley Spring Recovery Center, LLC ("Valley Spring," "we," "us," or "our"), governing your access to and use of our website located at valleyspringrecovery.com, including all associated pages, content, features, and services (collectively, the "Website").

Valley Spring Recovery Center is a CARF-accredited outpatient addiction and mental health treatment center located in Norwood, Bergen County, New Jersey. Our Website provides information about our treatment programs, services, and resources, including but not limited to:

  • Partial Hospitalization Program (PHP): Structured day treatment providing intensive therapeutic support while allowing patients to return home in the evening
  • Intensive Outpatient Program (IOP): Flexible 3-day and 5-day treatment tracks offering group therapy, individual counseling, and evidence-based therapeutic modalities
  • Virtual IOP (Telehealth): Remote intensive outpatient treatment delivered through secure, HIPAA-compliant video conferencing technology
  • Outpatient Program (OP): Continuing care and step-down services for individuals transitioning from higher levels of care
  • Mental Health Program: Specialized treatment for anxiety, depression, PTSD, bipolar disorder, OCD, and co-occurring disorders
  • Alumni Program: Ongoing community support and relapse prevention resources for individuals who have completed our programs

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL VALLEY SPRING RECOVERY CENTER, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, CONTRACTORS, LICENSORS, SERVICE PROVIDERS, SUBCONTRACTORS, SUPPLIERS, INTERNS, OR AFFILIATES BE LIABLE FOR ANY:

  • Indirect, incidental, special, consequential, or punitive damages
  • Loss of profits, data, use, goodwill, or other intangible losses
  • Damages resulting from your access to or use of (or inability to access or use) the Website
  • Damages resulting from any conduct or content of any third party on the Website

12 Governing Law

These Terms of Service and any dispute or claim arising out of or in connection with them, their subject matter, or their formation (including non-contractual disputes or claims) shall be governed by and construed in accordance with the laws of the State of New Jersey, without giving effect to any choice or conflict of law provision or rule.

Any legal suit, action, or proceeding arising out of or related to these Terms or the Website shall be instituted exclusively in the federal courts of the United States or the state courts located in Bergen County, New Jersey. You irrevocably submit to the exclusive jurisdiction of such courts and waive any objection to the exercise of jurisdiction over you by such courts and any objection to venue in such courts.

If any provision of these Terms is held by a court of competent jurisdiction to be invalid, illegal, or unenforceable for any reason, such provision shall be eliminated or limited to the minimum extent possible, and the remaining provisions of these Terms shall continue in full force and effect.

13 Dispute Resolution

We value our relationship with you and want to resolve any concerns or disputes as quickly and fairly as possible.

Informal Resolution

Before initiating any formal dispute resolution proceeding, you agree to first contact us directly to attempt to resolve the dispute informally. Most concerns can be resolved quickly and to your satisfaction by contacting us at the information provided in the Contact Us section below. We will make every reasonable effort to resolve your concern within thirty (30) business days of receiving your written notice.

Binding Arbitration

If informal resolution is unsuccessful, any dispute, controversy, or claim arising out of or relating to these Terms, or the breach, termination, or invalidity thereof, shall be settled by binding arbitration administered by the American Arbitration Association (AAA) in accordance with its Commercial Arbitration Rules. The arbitration shall take place in Bergen County, New Jersey, unless both parties agree to an alternative location or virtual proceedings.

Class Action Waiver

You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action. You expressly waive any right to participate in a class action lawsuit or class-wide arbitration against Valley Spring Recovery Center.

Exceptions

Notwithstanding the above, either party may seek injunctive or other equitable relief in any court of competent jurisdiction to prevent the actual or threatened infringement, misappropriation, or violation of a party's copyrights, trademarks, trade secrets, patents, or other intellectual property rights.

14 Changes to Terms

Valley Spring Recovery Center reserves the right to revise, modify, or update these Terms of Service at any time and at our sole discretion. When we make changes, we will update the "Effective Date" at the top of this page to reflect the date of the most recent revision.

We may, but are not obligated to, provide additional notice of significant changes, such as posting a prominent notice on our Website or sending an email notification to registered users. However, it is your responsibility to review these Terms periodically to stay informed of any updates.

Your continued use of the Website after the effective date of any revised Terms constitutes your acceptance of and agreement to be bound by the updated Terms. If you do not agree to the revised Terms, you must stop using the Website immediately.

No modification to these Terms by any party other than Valley Spring Recovery Center shall be valid or enforceable unless expressly agreed to by Valley Spring Recovery Center in writing.
