This limitation of liability applies whether the alleged liability is based on contract, tort, negligence, strict liability, or any other basis, even if Valley Spring Recovery Center has been advised of the possibility of such damages. In no event shall our total liability to you for all claims exceed the amount of one hundred dollars ($100.00).

These Terms of Service and any dispute or claim arising out of or in connection with them, their subject matter, or their formation (including non-contractual disputes or claims) shall be governed by and construed in accordance with the laws of the State of New Jersey, without regard to its conflict of law principles.
You agree that any legal action or proceeding arising under or related to these Terms shall be brought exclusively in the state or federal courts located in Bergen County, New Jersey, and you irrevocably consent to the personal jurisdiction and venue of such courts.
Any claim or cause of action arising out of or related to the use of the Site or these Terms must be filed within one (1) year after such claim or cause of action arose, or be forever barred.
In the event of any dispute, claim, or controversy arising out of or relating to these Terms or the use of the Site ("Dispute"), the parties agree to first attempt to resolve the Dispute informally. If the Dispute cannot be resolved through informal negotiation within the thirty-day period, either party may initiate binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. The arbitration shall take place in Bergen County, New Jersey, unless the parties mutually agree to an alternative location or virtual proceedings.
Class Action Waiver: You and Valley Spring Recovery Center agree that any Dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action. If for any reason a claim proceeds in court rather than in arbitration, both parties waive any right to a jury trial.
Nothing in this section shall prevent either party from seeking injunctive or other equitable relief in court for matters related to intellectual property, data security, or unauthorized access to the Site.
